Building Certificate Reports

The index of building cerficates under the Environmental Planning and Assessment Act 1979 is available to inspect or copy.

Access to building certificates is available in accordance with Schedule 1 (4)(f) of the Government Information (Public Access) Regulation 2009.  The indexes below list the applications for building certificates received by Strathfield Council.

Disclosure Log

A disclosure log is a record containing details of Council’s information already released under the Government Information (Public Access) Act 2009 (GIPA Act). A disclosure log is part of the open access information that Council is required to make publicly available.

Disclosure logs provide access to information for people who want the same or similar information as previous applicants, and would otherwise have to make formal access applications. A disclosure log also helps Council to identify information that could be proactively released.

The disclosure log must contain the following information:

  • the date that the access application was decided
  • a description of the information provided
  • whether any of the information is now publicly available and, if so, how it can be accessed.

The disclosure log does not have to include the following information:

  • information on applications for personal information regarding the applicant,
  • information about applications where factors involving the applicant were a consideration in whether or not the disclosure of the information was in the public interest.

Disclosure of Interest Returns

Council’s Return of Interests of Councillors, Designated Persons and Delegates is available as open access information in accordance with the Government Information (Public) Access Act 2009 (GIPA) on the Access to Information page.

 

End of Term Report

The End of Term Report is prepared at the end of the Council term, prior to a Council election. This publication reports on Council’s progress in the implementation of its Community Strategic Plan.

Government Contract Register

The Government Information (Public Access) Act 2009 (GIPA Act) requires Council to record and publish certain information about some contracts with private sector bodies.

Contracts to be recorded in the register of contracts are contracts between Council and private sector bodies worth more than $150,000 and involve:

  • the contractor undertaking a specific project such as construction, infrastructure or property development,
  • the contractor agreeing to provide specific goods or services,
  • the transfer or lease of real property.

Employment contracts are not included in the register.

Different classes of contracts

The GIPA Act provides for three different classes of contracts, each with different information requirements.  The different classes of contracts are:

Class 1 contracts

Refer to section 29 of the GIPA Act for the information to be recorded in the Register of Council Contacts for class 1 contracts.

Class 2 contracts

Class 2 contracts are class 1 contracts where:

there has not been a public tender process and the terms and conditions of the contract have been negotiated directly with the contractor, or

  • the contract was the subject of a tender (whether public or not) but the terms and conditions have been substantially negotiated with the contractor, or
  • the obligations of one or more parties to maintain or operate infrastructure or assets could continue for 10 years or more, or
  • the contract involves a privately financed project (as defined by Treasury), or
  • the contract involves the exchange of significant assets.

Class 3 contracts

Class 3 contracts are class 2 contracts that have a value, or likely value of more than $5 million. Council must publish a copy of class 3 contracts on the register of Council contracts subject to the exclusion of any confidential information identified in section 32 of the GIPA Act.

Council’s Government Contracts Register from previous years are available as open access information in accordance with the Government Information (Public Access) Act 2009 (GIPA) and may be viewed by application.

Public Land Register

The Public Land Register is prepared in accordance with Section 53 Local Government Act 1993.

This register contains a listing of public land, including community and operational classifications, which is owned or in the care and control of Council.

The register also contains land owned by other parties such as Crown Land and NSW State Agencies or Corporations, particularly where land is located within a park or used for open space.

This register has been compiled to not only meet the legislative requirements of the Local Government Act 1993, but also to act as a useful reference document in providing an overview of all land under Council’s management.

Register of Delegations

Council’s Delegations of Authority Register was last amended on 26 May 2023. This Register sets out the authorisations for Council’s authorised officers.

Register of Planning Decisions

Under section 375A of the Local Government Act 1993, the General Manager is required to keep a public register of planning and development decisions made at Council or Committee meetings, and record the name of Councillors who voted for and against the decisions. This applies to the following planning decisions:

  • Development applications
  • Environmental planning instruments
  • Development control plans
  • Development contribution plans

Council publishes agendas, business papers and minutes of Council meetings. It is the practice of Strathfield Council that Council and Committee resolutions are recorded in division (eg recording of how each Councillor votes). Therefore, information on voting can also be obtained by viewing the relevant meeting minutes.

Register of Political Donations

As per the Local Government and Planning Legislation Amendment (Political Donations) Act 2008, Local Government Act 1993 and the Environmental Planning and Assessment Act 1979. In order to enable members of the public with access to information such as current donations and expenditure declarations lodged by Councillors with the Electoral Commission NSW. Strathfield Council is providing the following link to the Electoral Commission NSW website.
