Purchasing or Selling a Property with a Pool

The owner of a property on which a swimming pool is situated must ensure that the pool complies with the requirements of the Swimming Pools Act 1992. Penalties apply for non-compliance. A Certificate of Compliance under s 24 of the Swimming Pools Act 1992is the only available document that an owner can rely on to ensure that their pool complies.

Before purchasing a property on which a pool is situated, you as the purchaser are strongly advised to ensure that the swimming pool complies with the requirements of the Act.

Purchasers and persons acting on their behalf are strongly advised to view a Pool Certificate of Compliance prior to purchasing any property on which any type of pool is situated.

Yes. Council inspects when complaints are made on request for pool certificates of compliance. It is also Council Officer’s responsibility to check your pool fence if they are on your property for other reasons. If your swimming pool or fence is found to be inadequate Council may require you to upgrade via a Swimming Pool Direction.
